Serve as deputy legal counsel on internal and external affairs for PacificSource and its subsidiaries and affiliates. Review, recommend and implement appropriate action based on legal principles, case histories, regulations, statutes, and laws governing the insurance industry, as well as PacificSource's business practice. Serve as an in-house resource to internal staff on points of law related to specific functional areas of the company, and recommend other resources as needed. Manage PacificSource's litigation, mediation and arbitration services, and negotiation of various legal issues.

Essential Responsibilities:

  • Provide supervision, coaching, training, evaluation, and leadership to assigned staff.
  • Take the lead in organizing and directing specific organizational legal activities to protect the organization's interests from a legal perspective.
  • Provide counsel in reference to relations with municipal, state and federal bureaus, departments, and agencies.
  • Take the lead with any legal action on behalf of the company and defend the organization in any legal action initiated against it, including selecting and managing outside legal firms.
  • Manage negotiation of legal issues with insured and their representatives. Work with internal representatives prior to litigation as needed to explore alternative settlement options.
  • Ensures that contracts, official correspondence, and communications meet the regulatory standards of the insurance industry and provide legal advice and guidance as to best practices on the same and/or PacificSource's best interests.
  • Review internal policies to ensure compliance with relevant state, federal, and local laws, and assist with and/or develop policies as necessary and appropriate.
  • Counsel and advise all organization executives on the legal aspects of activities within their assigned areas such as finance, taxes, insurance, patents, service, and trademarks, and the acquisition, protection, and disposal of real and personal property and businesses.
  • Serve as legal staff to the Board for certain Board Committee meetings.
  • Analyze developing trends in legal areas such as legislative issues, statutes, and decisions, ERISA, Medicare, and Medicaid.
  • Assume General Counsel responsibilities in the event of an absence.
  • Responsible for oversight, management, development, implementation, and communication of department programs.
  • Responsible for hiring, staff development, coaching, performance reviews, corrective actions, and termination of employees. Provide feedback, including regular one-on-ones and performance evaluations, for direct reports.
  • Develop annual department budgets. Monitor spending versus the planned budgeted throughout the year and take corrective action where needed.
  • Coordinate business activities by maintaining collaborative partnerships with key departments.
  • Responsible for process improvement and working with other departments to improve interdepartmental processes. Utilize lean methodologies for continuous improvement. Actively participate as a key team member in Manager/Supervisor meetings.
  • Actively participate in various strategic and internal committees in order to disseminate information within the organization and represent company philosophy.

Supporting Responsibilities:
  • Meet department and company performance and attendance expectations.
  • Follow the PacificSource privacy policy and HIPAA laws and regulations concerning confidentiality and security of protected health information.
  • Perform other duties as assigned.

SUCCESS PROFILE

Work Experience: Minimum of ten years of previous legal work experience, including five years in the healthcare industry. Advanced knowledge of contract, litigation, and business practices required.

Education, Certificates, Licenses: Licensed to practice law in the State of Oregon, or pass the Oregon State Bar examination within six months of employment. Additional licensure in Idaho, Montana and/or Washington a plus.

Knowledge: Requires excellent verbal and written communication skills. Ability to read, analyze, and interpret documents, schedules, reports, budgets, and correspondence. Ability to develop presentations and reports. Ability to effectively present information and respond to questions from a variety of groups, including staff, management, boards of directors, employees, and vendors. Strong research, analytical, organizational, and interpretative skills. Must be a versatile, business-minded individual with leadership skills. Ability to prioritize multiple urgent demands and work under pressure with a high attention to detail and quality in the work product. Established success in participating in a team-oriented work environment.

Environment: Work inside in a general office setting with ergonomically configured equipment. Travel is required approximately 10% of the time.

Physical Requirements: Stoop and bend. Sit and/or stand for extended periods of time while performing core job functions. Repetitive motions to include typing, sorting and filing. Light lifting and carrying of files and business materials. Ability to read and comprehend both written and spoken English. Communicate clearly and effectively.
